What is Authority to Sell/Lease?
Authority to Sell/Lease (ATS/ATL) is a document that gives us, as your representing broker, the consent to market your property for sale/lease. It usually contains the terms and agreement that authorizes us to help you market your property. An Authority to Sell/Lease may be Exclusive or Non-Exclusive.
This document is also executed in order to protect the broker not to be bypassed in dealing and negotiating your property, as well as to protect you, the seller, from any unwanted claims or misrepresentation on your property.

Why is Authority to Sell/Lease Required?
As per the Memorandum released by the Republic of the Philippines' Professional Regulation Commission (PRC) last June 19, 2019, all licensed Real Estate Brokers shall be mandatorily required to secure first a written Authority to Negotiate for Sale or Authority to Sell real estate or real properties from the registered owner(s) or from his/her/its Attorney-in-Fact prior to selling thereof.

Do you require Authority to Sell/Lease to be Exclusive Agreement?
No, but we do encourage. We generally issue non-exclusive agreements unless requested and agreed otherwise. But of course, we would also love to represent you if you want to give us an exclusive contract.
How do I make the Authority to Sell/Lease document?
We will help you produce this document. You just have to submit the other documents required and we will prepare them for your review and signature. However if you already have one and prefer to use your own format, please do let us know.
Why do we need to provide with you our property's Title, Real Property Tax and Ownership Documents?
The title of the property is required because we need to check the details are correct upon our preparation of Authority to Sell (ATS). This is also to verify your ownership to the property. Along with this, we also need to make sure that the title is clean to assure our buyers of their purchase.
Real Property Tax on the other hand is also to make sure that your taxes are paid and regularly updated as part of our due diligence. Hence the most current Real Property Tax receipt is required to be submitted.
Meanwhile, ownership documents are required for the Authority to Lease (ATL) to also make sure that you are the owner of the said property that we are going to help you lease out.
